Privacy Policy

This Privacy Policy explains how M&S Custom Design LLC ("we," "our," or "us") collects, uses, and protects information when you use MS Sync, a private operational platform accessible at https://sync.mscustomdesign.com (the "Service").

MS Sync is not a public consumer application. Access is granted by M&S Custom Design LLC to subcontractors, supervisors, and office staff with a pre-existing business relationship with the company. By signing in, you confirm that M&S Custom Design LLC authorized your account.

Mobile Information & SMS Data — A2P 10DLC Compliance

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

This statement applies specifically to:

  • Phone numbers collected at account creation.
  • SMS opt-in consent and acknowledgment records.
  • SMS message contents and metadata.
  • Any data captured as part of the SMS communication flow.

The categories of personal information described in the sections below — including the service providers listed in Section 5 — explicitly exclude text messaging originator opt-in data and consent. This information will not be shared with any third party, including affiliates, partners, or service providers operating on our behalf, except as strictly required to deliver the SMS service that the recipient has requested (i.e., the SMS carrier itself).

M&S Custom Design LLC does not sell, rent, lease, or share mobile phone numbers or SMS opt-in data with any third party for marketing purposes under any circumstances.

1. Information we collect

1.1 Account information

  • Phone number — required to sign in and to receive operational SMS notifications.
  • Personal identification number (PIN) — stored only as a salted bcrypt hash. We never see or store your raw PIN.
  • Name and business name — used to identify you in office views, invoices, and tax forms (e.g., IRS Form 1099 when required).
  • Mailing address — used only for mailing physical checks and required tax filings.

1.2 Work-product information

  • Project addresses, scopes of work, scheduled dates, and the amounts owed for each completed task.
  • Before and after photographs you upload as proof of completion.
  • Compliance documents you choose to upload (W-9, insurance certificates, signed agreements).

1.3 Automatically-collected information

  • Sign-in timestamps and the device approximate region (for security monitoring only).
  • Failed sign-in counts (used to lock an account after repeated incorrect PIN attempts, then automatically reset).
  • Server-side error logs that may include request paths and Firebase identifiers. We strip personally identifying data from logs whenever possible.

1.4 Information we do NOT collect

  • Email address (we use phone-based authentication).
  • Government-issued identification documents.
  • Bank account or credit card numbers.
  • Health, biometric, or precise GPS location data.
  • Information about your children. The Service is not intended for users under 18.

2. How we use information

We use the information you provide solely to operate the Service:

  • Extend Project Offers to you and confirm completion.
  • Calculate weekly invoices and prepare payment.
  • Send you operational SMS notifications (see Section 4).
  • Maintain audit logs for dispute resolution.
  • Comply with U.S. tax and labor reporting requirements.

We do not:

  • Sell, rent, or trade your personal information.
  • Use your information for marketing or advertising of any kind.
  • Share your information with third parties except as described in Section 5.

3. Legal bases (for users in jurisdictions that require them)

We process your information to perform the contractor-services contract between you and M&S Custom Design LLC, to comply with applicable law, and to pursue our legitimate interests in operating a secure platform. Where consent is required (for SMS communications), we rely on the separate, optional SMS opt-in you provide by checking the dedicated SMS consent checkbox on the acceptance screen (and on the Compliance page thereafter). SMS consent is not bundled with acceptance of our Terms of Service or the Independent Contractor Agreement.

4. SMS Communications

Subcontractors may separately and optionally consent to receive operational SMS messages from MS Sync by checking the optional SMS consent checkbox on the acceptance screen (and on the Compliance page thereafter). Accepting the Terms of Service or the Independent Contractor Agreement does not, by itself, enroll a subcontractor in SMS messaging. Subcontractors who decline this optional opt-in still have full access to the platform; only proactive SMS notifications are suppressed for them. If you opt in, the messages are limited to:

  • Notification when a new Project Offer is available to you.
  • Notification when your completed work is approved or sent back for corrections.
  • Reminders related to compliance documents (insurance expiration, missing W-9) when applicable.

Field supervisors may also receive a confirmation message after texting in a new job request. Office staff may receive optional alerts related to the operations queue.

Message frequency varies with your activity but typically stays under ten messages per week per person. Standard message and data rates may apply, depending on your carrier plan.

You can opt out at any time. Reply STOP to any message we send you. We will stop further SMS to that number, and the carrier will confirm the opt-out automatically. To resume notifications later, reply START or contact contact@mscustomdesign.com.

For help, reply HELP to any message. We do not use SMS for marketing of any kind. We do not share your phone number with third parties for their own marketing.

5. Service providers

We rely on the following processors to run the Service. Each is bound by contract and data-protection terms that prohibit any use of your data other than to provide their service to us.

  • Google Firebase (authentication, database, file storage) — hosted in the United States.
  • Vercel (web application hosting) — hosted in the United States.
  • Twilio (SMS and, in the future, WhatsApp messaging) — hosted in the United States.
  • Anthropic (AI text understanding for inbound messages from field supervisors only — not for contractor data) — hosted in the United States.

6. Data retention

We keep your account information for as long as you remain an active contractor or supervisor in the system, plus the period required by U.S. tax law (currently seven years for invoice and payment records). When you become inactive and the retention period expires, we delete or anonymize your records.

Photographs and project records are retained for at least three years after project completion to support warranty and dispute resolution.

7. Security

  • PINs are stored only as salted bcrypt hashes.
  • All traffic is encrypted in transit (HTTPS / TLS 1.2+).
  • Data at rest is encrypted by our service providers.
  • Access to office tools requires a separate email-password account with a verifiable office_admin role.
  • Service-account keys for our backend are rotated periodically and on suspicion of compromise.

No security measure is perfect. If you believe your account was accessed without your permission, contact us immediately at contact@mscustomdesign.com.

8. Your rights

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you.
  • Request correction of inaccurate information.
  • Request deletion of your information (subject to legal-retention requirements).
  • Object to or limit how we process your information.
  • Receive a copy of your information in a portable format.

9. Children

The Service is intended for users 18 years of age or older. We do not knowingly collect personal information from children.

10. Changes to this policy

We may update this Privacy Policy from time to time. Material changes will be communicated in-app at sign-in and via the email or SMS we have on file. The "Effective date" above will be updated when changes take effect.
